Welcome to Body Wise™!

These Terms of Service (“Terms”) govern your use of https://officialbodywise.com and related services (the “Services”) operated by Body Wise, a sole proprietorship based in West Palm Beach, Florida.

By using our website or placing an order, you agree to these Terms and the applicable policies referenced here, including our Return & Refund Policy and Privacy Policy.

Subscription enrollment and recurring billing require your separate, express agreement to the subscription terms presented before purchase.

1. Online Store Terms

You must be at least the age of majority in your state of residence to make a purchase.

You may not use our products or Services for an illegal or unauthorized purpose or in violation of applicable law.

2. General Conditions

We reserve the right to refuse service where permitted by law, including in cases of suspected fraud, abuse, or violations of these Terms.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our express written permission.

Payment transactions are handled through third-party payment providers. Our handling of personal information is described in our Privacy Policy.

3. Website Information

We strive to keep product descriptions, pricing, and other website information accurate and current. Occasionally, information may contain errors or omissions.

We may correct errors and update information. If an error materially affects an order you have placed, we will contact you about the correction or cancel the affected order and refund any payment collected.

Website content is provided for general information and does not replace advice from a qualified healthcare professional.

4. Changes to Services and Prices

We may change prices, modify website features, or discontinue products.

Price changes do not change the amount owed for an order already accepted.

For active subscriptions, we will provide advance notice of changes to recurring prices or other material subscription terms and obtain consent where required by law. You may request cancellation before a change takes effect, subject to applicable law.

5. Products and Availability

Some products may be available exclusively online and may have limited quantities.

We make reasonable efforts to display product images and colors accurately, but their appearance may vary depending on your device.

We may limit quantities or restrict sales to particular locations where permitted by law.

Returns, refunds, and replacements are governed by our Return & Refund Policy and applicable law.

6. Billing and Account Information

You agree to provide current, complete, and accurate billing, shipping, and account information.

Please keep your email address and payment details updated so we can process orders and contact you when necessary.

We may refuse or cancel orders involving suspected fraud or unauthorized activity. If we cancel an order after collecting payment, we will refund the canceled order.

Payment options available at checkout may include:

• Credit or debit cards through Shopify Payments

• PayPal

• Shop Pay

• Apple Pay

• Google Pay

Applicable taxes and shipping charges are displayed at checkout.

7. Subscriptions and Automatic Renewals

Subscription Enrollment

A subscription provides recurring product orders at the price and billing frequency disclosed before purchase.

By actively selecting and expressly agreeing to a subscription, you authorize Body Wise™ and its payment providers to charge your selected payment method for the initial order and subsequent recurring orders according to those disclosed terms.

Simply viewing these Terms does not authorize recurring charges.

Minimum Commitment: Two Paid Monthly Orders

For monthly subscriptions offered with a minimum commitment, you agree to complete two paid monthly orders:

1. Your initial subscription order

2. One monthly renewal order

This is the subscription’s minimum two-order commitment. It must be clearly disclosed and expressly accepted when you enroll.

Subject to applicable law, cancellation takes effect after these two required paid orders have been completed.

The minimum commitment applies only to subscriptions enrolled under these disclosed and accepted conditions. It does not apply retroactively to subscriptions purchased under different terms.

Automatic Renewals

After the minimum commitment is completed, your subscription continues to renew automatically at the disclosed billing frequency until canceled.

Your payment method will be charged for each scheduled renewal unless cancellation has taken effect before that charge.

How to Cancel

Request cancellation by emailing support@officialbodywise.com with your name, the email address used at checkout, and your order number if available.

You may submit a cancellation request before completing the minimum commitment. We will record the request and schedule cancellation after the second required paid order so no third renewal is charged.

After completing the minimum commitment, you may cancel future renewals by submitting your request before your next scheduled charge.

We will confirm cancellation by email. Any additional cancellation controls available through your subscription account may also be used.

Orders Already Charged

Cancellation stops future renewals when effective. It does not automatically cancel or refund an order already charged.

Returns and refund requests for subscription orders are handled under our Return & Refund Policy.

Returning a product, requesting a refund, or unsubscribing from marketing messages does not automatically cancel your product subscription. Please submit a separate cancellation request.

Unauthorized Enrollment and Legal Rights

If you believe you were enrolled or charged without authorization, contact us promptly so we can investigate.

Nothing in these Terms limits cancellation, refund, or other rights provided by applicable law. Where the law requires earlier cancellation or other protections, those requirements apply.

8. Third-Party Tools and Links

We use third-party services, which may include Shopify, PayPal, Zendrop, subscription management providers, and advertising or analytics tools from Meta, TikTok, and Google.

Third-party services and external websites may have their own terms and privacy policies. We do not control their independent content or practices.

This section does not limit our responsibilities to you under applicable law.

9. Intellectual Property

Website content, branding, logos, graphics, and other materials are owned by Body Wise™ or used with permission and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, sell, or otherwise exploit these materials without permission, except as permitted by law.

10. Prohibited Uses

You may not use our website or Services to:

• Engage in unlawful activity.

• Infringe intellectual property or other legal rights.

• Submit fraudulent or misleading information.

• Upload viruses or other malicious code.

• Collect other users’ personal information without authorization.

• Interfere with website operation or security.

• Harass, threaten, or abuse others.

We may suspend or terminate access for violations, subject to applicable law.

11. Disclaimer of Warranties and Limitation of Liability

We do not guarantee that the website will always be uninterrupted or free from errors.

To the fullest extent permitted by law, the website and Services are provided “as is” and “as available,” except for any express warranties or commitments we provide.

To the fullest extent permitted by law, Body Wise™, its owner, and affiliates are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or removes any mandatory consumer rights or product warranties.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Body Wise™ and its affiliates, partners, suppliers, contractors, and employees against third-party claims arising from your unlawful use of the Services, violation of these Terms, or infringement of another party’s rights.

This provision does not require you to indemnify us for our own negligence or unlawful conduct.

13. Severability

If a provision of these Terms is found unlawful or unenforceable, it will be limited or removed to the extent necessary.

The remaining provisions will continue in effect.

14. Termination

We may suspend or terminate access to the Services for violations of these Terms, subject to applicable law.

Termination of website access does not itself cancel an active subscription. Subscription cancellations are handled under Section 7.

Provisions that reasonably need to survive termination, including intellectual property provisions and lawful liability limitations, remain in effect.

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States, except where applicable law requires otherwise.

Nothing in this section deprives you of mandatory consumer protections that apply where you live.

16. Changes to These Terms

We may update these Terms periodically. The current version will display its “Last updated” date.

Updates will not retroactively impose a new minimum commitment on existing subscriptions. We will provide notice of material changes and obtain consent where required by law.
